Service Agreement Terms

This document constitutes an agreement between Propertify Ai, located at Montreal Canada ("Propertify Ai" or "us") and the user ("you" or "the customer"). By engaging with us, you agree to be bound by the following terms of service.

1. Applicability

   These terms of service govern all interactions and agreements between you and Virtual Staging Solutions LLC, facilitated through our website, www.propertify.ai, to which you have consented.

2. Agreement Formation

   Your agreement with Virtual Staging Solutions is established upon your selection and confirmation of the "Subscribe now" option.

3. Role of "Stripe" as Payment Processor

   Orders placed with us are processed through our online payment service, Stripe, Inc., a leading provider of internet payment solutions. By completing a purchase via our platform, you enter into a separate payment processing agreement with Stripe, which establishes your rights and duties regarding the use of Stripe's services. This payment processing agreement with Stripe is independent of and does not modify your service agreement with Propertify Ai. Should your agreement with Stripe be terminated or suspended, it will not affect your service agreement with Propertify Ai. By choosing to use Propertify Ai services, you agree to engage Stripe for payment processing and to meet your payment obligations to Stripe as required. Failure to uphold these obligations or the termination of your Stripe agreement contrary to the terms agreed upon with Propertify Ai may result in your direct financial liability to Propertify Ai.

4. Subscription Duration and Payment Terms

   Your subscription term depends on your selection between a "Monthly Plan" and a "Yearly Plan". Yearly Plan subscribers agree to prepay for 12 months for the chosen service tier. Cancellation within the initial 12 months takes effect at the end of that period, and if not canceled, the subscription automatically renews for another 12 months. Monthly Plan subscribers agree to a month-by-month payment, with the ability to cancel any time during the initial month. Failure to cancel converts the Monthly Plan into a Yearly Plan at the then-current rate, subject to the Yearly Plan's terms.

5. Product Quality

   The automated creation or editing of images means we cannot guarantee that outcomes will always meet high-quality standards. Services are provided "as is," with no warranties regarding the final product appearance. We may offer free revisions at our discretion.

6. Limitation of Liability

   We are not liable for any content generated by the AI that may be misleading, false, offensive, or illegal from the perspective of others. We disclaim responsibility for any resulting damages, including lost profits or savings. We are unaware of the intended use of the output data (text, images, etc.), and thus cannot be held responsible for any damages arising from its use.

7. Copyright

   You warrant that any materials you provide us (text, images, trademarks, etc.) are either your property or you have the rights to use them. In using our services, you grant us a non-exclusive, worldwide license to use these materials for any purpose. By registering with a company email, you permit us to use your company's logo for advertising purposes.

8. General Provisions

   This agreement is tailored for business clients. By entering this agreement, you confirm that you are not a consumer. The laws of Canada govern this agreement, and any disputes will be handled by the courts near Propertify Ai office.

9. Severability

   If any provision of this agreement is found to be invalid, illegal, or unenforceable, that provision will be considered separable from the rest, which will remain valid and enforceable.
